Leveling the Playing Field examines the admissions policies of contemporary American colleges and universities in light of the assumption that enhancing the educational opportunities of lower-income and minority students would make American society more just. The book evaluates controversies about such issues as the nature of merit, the missions of universities, affirmative action, the role of standardized tests, legacy preference, early decision, financial aid, the test-prep industry, and athletics.

Hume's theory of practical rationality, it has been claimed, fails to account for the intrinsically social character of practical deliberation and of the norms governing action. While the standard way of pressing this critique is unsuccessful, it can be advanced in another way. It is alleged that Hume cannot explain how it is possible to act contrary to reason because he holds that practical reasons are grounded in brute desires which are beyond the reach of rational criticism. But Hume offers (...) a rich explanation of practical irrationality. To show that Hume's theory of practical reason is too individualistic, a problem in his account of theoretical reason must first be appreciated. Hume thinks that rational agents should only trust in testimony about matters of fact when that trust can be reductively justified on the basis of their own observations. Such a stringently individualistic criterion would shrink the scope of human knowledge beyond recognition. Similarly, Hume thinks that rational agents should only trust advice---testimony about what is valuable or desirable---when that trust can be instrumentally justified in terms of their own antecedent values or desires. Individuals bound by this criterion would be unable to deliberate rationally when faced with novel and challenging circumstances. Humean theories must treat trust in advice as default justified if this problem is to be avoided. (shrink)

Forty-three years ago Max Weber observed that “the belief in the value of scientific truth is not derived from nature but is a product of definite cultures.” We may now add: and this belief is readily transmuted into doubt or disbelief. The persistent development of science occurs only in societies of a certain order, subject to a peculiar complex of tacit presuppositions and institutional constraints. What is for us a normal phenomenon which demands no explanation and secures many ‘self-evident’ cultural (...) values, has been in other times and still is in many places abnormal and infrequent. The continuity of science requires the active participation of interested and capable persons in scientific pursuits. This support of science is assured only by appropriate cultural conditions. It is, then, important to examine those controls which motivate scientific careers, which select and give prestige to certain scientific disciplines and reject or blur others. It will become evident that changes in institutional structure may curtail, modify or possibly prevent the pursuit of science. (shrink)

Our society's longstanding commitment to the liberty of conscience has become strained by our increasingly muddled understanding of what conscience is and why we value it. Too often we equate conscience with individual autonomy, and so we reflexively favor the individual in any contest against group authority, losing sight of the fact that a vibrant liberty of conscience requires a vibrant marketplace of morally distinct groups. Defending individual autonomy is not the same as defending the liberty of conscience because, although (...) conscience is inescapably personal, it is also inescapably relational. Conscience is formed, articulated, and lived out through relationships, and its viability depends on the law's willingness to protect the associations and venues through which individual consciences can flourish: these are the myriad institutions that make up the space between the person and the state. Conscience and the Common Good reframes the debate about conscience by bringing its relational dimension into focus. (shrink)

Morality and religion: intimately wed, violently opposed, or something else? Discussion of this issue appears in pop culture, the academy, and the media―often generating radically opposed views. At one end of the spectrum are those who think that unless God exists, ethics is unfounded and the moral life is unmotivated. At the other end are those who think that religious belief is unnecessary for―and even a threat to―ethical knowledge and the moral life. -/- This volume provides an accessible, charitable discussion (...) that represents a range of views along this spectrum. The book begins with a lively debate between Paul Kurtz and William Lane Craig on the question, Is goodness without God good enough? Kurtz defends the affirmative position and Craig the negative. Are mystical experiences primarily formed by the mystic's cultural background and concepts, as modern day "constructivists" maintain, or do mystics in some way transcend language, belief, and culturally conditioned expectations? Do mystical experiences differ in the different religious traditions, as "pluralists" contend, or are they identical across cultures? Twelve contributors here attempt to answer these questions through close examination of a particular form of mystical experience, "Pure Consciousness"--the experience of being awake but devoid of intentional content for consciousness. The contributors (...) analyze pure consciousness and other mystical experiences from historical Hindu, Buddhist, Christian, and Jewish sources, as well as from modern mystics. They demonstrate that pure consciousness poses serious conceptual problems for a contructivist understanding of mysticism. Revealing the inconsistencies and inadequacies of current models, they make significant strides towards developing new models for the phenomenon of mysticism, breaking new ground for our understanding of mysticism and of human experience in general. In the spirit of praxis, I connect Lacanian theory with the practice of making a video. Lucky in Savannah, which is an experimental adaptation of “Lucky’s speech” from Samuel Beckett’s masterpiece, Waiting for Godot —"[t]he prototype of a modernist text” according to Slavoj Žižek. For Žižek, Beckett—rather than Shakespeare—is “a kenotic writer, a writer of utter self-emptying of subjectivity, of its reduction to a minimal difference”. Will Greenshields argues that Žižek goes further than Lacan, and even performs an anti-Žižekian move (...) when choosing Beckett over Joyce: “While for Joyce the beginning and end were so close as to be indistinguishable…for Beckett there is such a thing as a beginning, a bare minimum, and if the truly revolutionary act is to be achieved, one must return to it”. For these reasons, it is certainly worthwhile to consider Beckett avec Žižek and others. In my video, I employ a Beckettian aesthetic informed by Lacanian psychoanalysis, which leads me to the following question: Is Lucky's speech an example of “full speech” par excellence, or is it a Real manifestation of the sinthome as "the meaningless letter that immediately procures jouis-sense, ‘enjoyment-in-meaning,' 'enjoy-meant'"? What do well-known theories look like if formulated with a relevant rather than a standard classical or intuitionist logic? Do familiar reconstructions of these theories go through, or do we change the reconstruction when we change the logic? I show in this paper that a new class of fallacies arises when we take the familiar Peano postulates as the foundation for a relevant theory of the natural numbers N. For these postulates fail in the relevant context to establish the relevant (...) cancellation theorem. Put otherwise, there are fallacies of division in arithmetic formulated relevantly! (shrink)

Although the system T of ticket entailment is obviously related to its cousins E and R , it is motivated along quite distinctive lines in Anderson and Belnap [1975]. It would seem, accordingly, that T is more nearly akin to the system P W studied in Martin [1978] than to E and R. The result presented here, however, at least suggests the contrary.

Sentential constants have been part of the R environment since Church [1]. They have had diverse uses in explicating relevant ideas and in sim- plifying them technically. Of most interest have been the Ackermann pair of constants t; f, functioning conceptually as a least truth, and as a greatest , under the ordering of propositions under true impli- cation. Also interesting have been the Church constants F; T, functioning similarly as least greatest propositions.

This is a sequel to Forman's well-received collection, The Problems of Pure Consciousness (OUP 1990). The essays in this previous volume argued that some mystical experiences do not seem to be formed or shaped by the language system--a thesis that stands in sharp contrast to the constructivist school, which holds that all mysticism is the product of a cultural and linguistic process. In The Innate Capacity, the same scholars put forward a hypothesis about the formative causes of these "pure consciousness" (...) experiences. All the contributors agree that mysticism is the result of an innate human capacity, rather than a learned, socially conditioned constructive process. They look at mystical experience as it is manifested in a variety of religious and cultural settings, including Hindu Yoga, Buddhism, Sufism, and medieval Christianity. Taken together, the essays constitute an important contribution to the ongoing debate about the nature of mystical experience and its relation to the social and cultural context in which it appears. Within medical ethics, there is widespread agreement that morally valid consent includes an understanding condition. Disagreement centers on what is meant by that understanding condition. Tom Dougherty proposed that this understanding condition should be divided into the two mutually exclusive categories of descriptive information and contextual information. Further, Dougherty argues that each type of information is necessary to satisfy the understanding condition. In contrast, I argue that when the deontic aspect of valid consent is in view, each type of information (...) can be sufficient to satisfy the understanding condition on its own. Moreover, by analyzing delegation, which is conceptually related to consent since both are morally transformative actions, I show that delegation often depends not on descriptive or contextual information but on trust. So, I argue that trustworthiness can also be a type of information that does the same work as descriptive and contextual information in satisfying the understanding condition for valid consent. give a proof of the existence of nonlocal influences acting on correlated spin-1/2 particles in the singlet state which does not require any particular interpretation of quantum mechanics (QM). (Except Stapp holds that the proof fails under a many-worlds interpretation of QM—a claim we analyse in 1.2.) Recently, in responding to Redhead's ([1987], pp. 90-6) criticism that the Stapp 1 proof fails under an indeterministic interpretation of QM, Stapp [1989] (henceforth Stapp 2), has revised the logical structure of his proof (...) including its crucial locality assumption. Our main aim is to show that this revision is a step in the wrong direction because it faces two difficulties which undermine the resulting proof's significance (3.1) and validity (3. 2). We also clarify and extend the Stapp 1 proof (1. 1) with the aid of Lewis' analysis of counterfactuals (1. 2) and causal dependence (2. 2 and 2. 3). In so doing, we are able to identify two new defects in the Stapp 1 proof (1. 3 and 2. 1) in addition to corroborating Redhead's criticism (2. 2). Also, the additional assumptions which save the Stapp 1 proof's validity are detailed (2. 3) and some new difficulties for the determinist are pointed out by exploiting a slightly extended version of the proof (2. 4). In providing this full analysis of the Stapp 1 proof, we also construct the necessary framework within which to provide a critique of Stapp 2's proof (3). *Portions of this paper were presented by R. In this essay, I start by addressing the question of “has Islamophobia reached a tipping point in the United States”? Then I apply Lacanian social theory, drawing on Slavoj Žižek’s analysis of anti-Semitism through the seven veils of fantasy, to Islamophobia in an effort to conceptualize the complex psychosocial phenomenon as a fundamental fantasy, which ideologically sustains the ‘war on terror’ discourse. Finally, I end with a brief remark on the possibility of Islamophobia as a counter-discourse.

This book seeks to reframe our understanding of the lawyer's work by exploring how Martin Luther King, Jr built his advocacy on a coherent set of moral claims regarding the demands of love and justice in light of human nature. King never shirked from staking out challenging claims of moral truth, even while remaining open to working with those who rejected those truths. His example should inspire the legal profession as a reminder that truth-telling, even in a society that often (...) appears morally balkanized, has the capacity to move hearts and minds. At the same time, his example should give the profession pause, for King's success would have been impossible without his substantive views about human nature and the ends of justice. This book is an effort to reframe our conception of morality's relevance to professionalism through the lens provided by the public and prophetic advocacy of Dr King. (shrink)
